No, kratom is illegal in Louisiana. Under Act 41 of the 2025 Regular Session (SB 154), in effect since August 1, 2025, "it is unlawful for any person in Louisiana to knowingly or intentionally produce, manufacture, distribute, dispense or possess Kratom," according to the Louisiana Department of Revenue.

Current Louisiana kratom law
Louisiana went from legal to banned in a single legislative session. SB 154, sponsored by Sen. Morris, passed in the 2025 Regular Session and became Act 41 (Legislature digest).
What the Department of Revenue's notice says the law does:
- Bans the full chain: producing, manufacturing, distributing, dispensing and possessing kratom are all unlawful.
- Sets serious penalties: up to five years in prison and fines up to $50,000, "depending on the quantity involved."
- Reaches licensed retailers: stores holding alcohol or tobacco permits "cannot sell or store kratom products." The notice came from the department's Office of Alcohol and Tobacco Control, which licenses those stores.
Because possession itself is illegal, there's no minimum age, labeling rule or testing requirement in Louisiana. That also means a product's packaging doesn't matter: leaf powder, capsules, teas, extracts and shots all fall under the same prohibition, whether they're sold as kratom or under another name. Buying in a neighboring state and bringing it home doesn't avoid the possession offense.
Parish and city rules
Local rules don't change the answer in Louisiana. State law prohibits kratom everywhere, and no parish or city can allow what the state bans.
7-OH and synthetic kratom
Act 41 covers kratom broadly, so concentrated 7-OH products are illegal along with leaf. Federally, the DEA placed three 7-OH-related compounds in Schedule I on August 26, 2026 (Federal Register); its proposed 7-OH order was still pending in early September 2026. More in what is 7-OH.

We found no 2026 bill to repeal or soften the ban. Louisiana's 2025 ban was followed by new bans in Connecticut, Kansas and Tennessee in 2026.
