Current Wisconsin kratom law
Wisconsin has scheduled kratom's two main alkaloids since 2014, according to trackers including Restoration Recovery and EZ Kratom. Because it bans the alkaloids rather than a product type, the ban covers every form: leaf powder, capsules, teas and extracts.
Wisconsin is one of the long-standing ban states, alongside Alabama, Arkansas, Indiana and Vermont. Rhode Island, which also banned kratom for years, reversed its ban in April 2026 (Restoration Recovery); Wisconsin hasn't.
Penalties. One tracker (EZ Kratom, a kratom seller) describes simple possession as a misdemeanor with up to six months in jail and a $1,000 fine, and manufacture or distribution as a Class H felony. We didn't confirm the exact penalty provisions in the statutes, so check with an attorney.
There's no minimum age, labeling rule or testing standard, since there's no legal market.

Because the ban is statewide, city and county rules don't change anything in Wisconsin.
7-OH and synthetic kratom
7-hydroxymitragynine is itself Schedule I in Wisconsin, so concentrated 7-OH products are illegal along with leaf. Recent changes and pending bills
AB 393 (2023) would have taken kratom off Schedule I and created a regulated market. According to the bill text, it would have:
- required processors to hold food processing licenses and register products with the Department of Agriculture, Trade and Consumer Protection
- banned products with synthetic alkaloids or "7-hydroxymitragynine greater than 1 percent"
- banned sales to anyone under 21
- required age and identity verification for online sales
It was referred to the Assembly Committee on State Affairs in September 2023 and didn't become law; kratom is still Schedule I. A legislation tracker updated September 27, 2026 listed no active Wisconsin kratom bill.
