Yes, kratom is legal in Texas for adults 18 and older. The Texas Kratom Consumer Health and Safety Protection Act (SB 497, in effect since September 1, 2023) regulates kratom rather than banning it, with labeling rules, a 2% cap on 7-OH and a ban on synthetic alkaloids.

Current Texas kratom law
According to the Senate Research Center's analysis of SB 497 as enacted, Texas law:
- Sets an 18+ age limit. "A person commits an offense if the person distributes, sells, or exposes for sale a kratom product to an individual younger than 18 years of age." It's a Class C misdemeanor.
- Caps 7-OH. Products can't contain "a level of 7-hydroxymitragynine in the alkaloid fraction that is greater than two percent of the overall alkaloid composition."
- Bans synthetics. No "synthetic alkaloids, including synthetic 7-hydroxymitragynine and synthetically derived compounds from a kratom plant."
- Requires labels with use directions and a recommended serving size. Retailers may sell only properly labeled products.
- Sets civil penalties of $250, $500, then $1,000 for repeat violations. Retailers can avoid penalties by showing good-faith reliance on the processor's representations.
The law doesn't create a registration or licensing system, and it doesn't require independent lab testing before sale.
A note on the age limit: some trackers list Texas as a 21+ state. We couldn't find a Texas law that sets 21. The enacted statute says 18, and UT Health East Texas also described the minimum as 18 in April 2026. Many online vendors sell only to adults 21+ as their own policy.
Local and city rules
We found no Texas city ordinance banning kratom in an official source. One vendor, Super Speciosa, lists five Texas cities it won't ship to: Angleton, Anna, Baytown, Bridgeport and Manvel. We couldn't confirm local ordinances in those cities, so treat that list as vendor-reported. None of the other seven vendors we track lists a Texas locality.
7-OH and synthetic kratom in Texas
On paper, Texas has had 7-OH limits since 2023. Enforcement is another matter. In August 2025 the Texas Tribune reported that concentrated 7-OH products were still widely sold and that agencies "don't have the resources to enforce the ban" on synthetic versions.
Federal action may matter more. The DEA placed three 7-OH-related compounds in Schedule I on August 26, 2026 (Federal Register), and its proposed threshold order on 7-OH itself was still pending in early September 2026. Read what is 7-OH.

Recent changes and pending bills
- September 1, 2023: SB 497 takes effect.
- April 24, 2025: SB 1868, which would have added kratom to the controlled substances list, passes the Senate.
- June 2, 2025: Session ends with SB 1868 stuck in the House Public Health Committee (CBD Kratom summary, third-party; Texas Tribune).
A bill filed in the 2025 first called session (HB 291) would have raised the age to 21, cut the 7-OH cap to 0.1% and banned kratom sales where hemp, tobacco or alcohol are sold (bill text). We found no sign it passed. The next regular session starts in January 2027.
