Yes, kratom is legal in New York for adults 21 and older. Governor Kathy Hochul signed two laws on December 22, 2025 that set a statewide 21+ age limit and require warning labels. New York is one of the few states where counties are the main source of bans: Nassau County's legislature voted to ban kratom sales, and Albany and Oneida counties have health orders doing the same.

Current New York State law
The two December 2025 laws, per the governor's office:
- S4552A/A2340A (age): no kratom sales to anyone under 21. Sellers face fines of up to $500 per offense.
- S8285/A5852A (labels): products must list all ingredients and carry a consumer warning that the product "may be addictive and may interact with certain medications, drugs and controlled substances."
The release didn't give effective dates for each law, so check with the retailer or the bill text if timing matters to you. New York has no statewide testing or alkaloid-limit standard for leaf kratom.
County bans: the patchwork
This is where New York gets complicated. Counties have moved faster than Albany:

Washington County and Saratoga County had proposed sales bans in 2026 as well; we couldn't confirm whether they passed. Given how fast this list is growing, check your county's health department before buying.
7-OH and synthetic kratom in New York
The Legislature passed S8925A in June 2026. It would ban the sale of products with more than 2% 7-OH of total alkaloids or more than 1 mg per serving, with civil penalties of $500 and up to $1,000 for repeat violations, enforced 90 days after signing (ISSUP summary, third-party; Assemblymember Steck). As of July 2026 it awaited Governor Hochul's action. We couldn't confirm whether it was signed by September 28, 2026.

Buying kratom online in New York
None of the eight vendors we track lists New York State, or any New York county, on its shipping-restriction page as of September 28, 2026 (Happy Hippo, Left Coast, Kats, Kraken, Super Speciosa, Kona). Golden Monk and MIT45 say they don't ship where kratom is restricted but publish no list.
The county bans we found target retail sales, and vendor lists haven't caught up. If you live in Nassau, Albany or Oneida County, don't assume a successful checkout means the order is allowed.
