Yes, kratom is legal in Florida for adults 21 and older, under the Kratom Consumer Protection Act (§ 500.92, Florida Statutes), in effect since July 1, 2023. But concentrated 7-OH products are Schedule I under Attorney General emergency rules, and Sarasota County bans kratom altogether.

Current Florida kratom law
Florida treats plain kratom and 7-OH as two separate problems.
Leaf kratom is regulated under the 2023 Kratom Consumer Protection Act. According to a summary of the statute and rules (third-party):
- It's unlawful to sell or give kratom products "to a person who is under 21 years of age." A violation is a second-degree misdemeanor.
- The Department of Agriculture (FDACS) rule 5K-4.030 requires a food establishment permit, point-of-sale age signs and no vending machine sales.
- A separate FDACS rule requires labels to state 7-OH concentration in parts per million.
The law covers leaf, powders, capsules, extracts and beverages made from Mitragyna speciosa.
Local bans: Sarasota County
Sarasota County has banned kratom under its county code since 2014, per the same summary. Vendors treat the whole Sarasota area as off-limits. Super Speciosa, for example, blocks Englewood, Laurel, Longboat Key, Nokomis, North Port, Osprey, Sarasota, Venice and other nearby addresses (shipping page).
Vendor lists also mention a "Union County" ban, but they place it in North Carolina (Happy Hippo) and Mississippi (Kats Botanicals), not Florida.
7-OH and synthetic kratom in Florida
This is the part of Florida law that's changed most. Florida was one of the first states to go after 7-OH directly:
- August 2025: Attorney General James Uthmeier signed an emergency rule placing 7-OH in Schedule I (AG release).
- June 22, 2026: A new emergency rule expanded the list to seven compounds: 7-hydroxymitragynine, mitragynine pseudoindoxyl, 7-acetoxymitragynine, 9-hydroxycorynantheidine, 10-hydroxycorynantheidine, MGM-15 and MGM-16.
The June rule sets a threshold of 1 milligram of these compounds per gram (solids) or per milliliter (liquids), and requires at least 100 times more mitragynine than 7-OH by mass. The AG's office said natural kratom isn't affected because the compounds occur in leaf only in trace amounts. FDACS Commissioner Wilton Simpson said the department had removed more than 23,000 illegal 7-OH packages from retailers (Florida Phoenix).
Emergency rules are temporary. The third-party summary above says the current rule runs until June 30, 2027 unless the Legislature puts it into statute; we couldn't confirm the expiry on the state's own site.

No vendor we track blocks Florida as a whole. Sarasota County is a different story:

Recent changes and pending legislation
- July 1, 2023: Kratom Consumer Protection Act takes effect (21+).
- August 2025: First 7-OH emergency rule.
- June 22, 2026: Rule expanded to seven compounds.
We didn't find a pending bill to ban leaf kratom in Florida. The open question is whether lawmakers make the 7-OH rules permanent.
